First, vfielder don't depend on just one source. I see the quote you're referring to and you're reading too much into it. Read a few law books and think about how things work in real life before throwing out random trash.
Now... Samantha, your fiance should not have been arrested in the first place. By simple traffic violation I'm assuming speeding or running a red light, not like a DUI or something correct? This is why I gave a simple answer, it was a simple question without much details.
But where we're at now with the details I have, the fact that your fiance shouldn't have been arrested is what you need to bring up in court and fight against.
Of course with more details comes more accurate answers and better answers. 
What was the violation? Is he still being held? Are there any other charges? Is there a court date? Blah blah blah...
